    Application

    • The 2009 lemon law is effective for new boats, outboard marine gasoline motors, or a boat that is already equipped with a motor. Other covered vehicles include all-terrain vehicles (ATV) and snow machines. It does not cover any craft that is designed to be propelled by human power, such as a rowboat or kayak.

    Requirements

    • In order to take advantage of the boating lemon law, you must give the dealer at least three opportunities to correct any problem with the vehicle. The first notice of a problem must be made to the dealer either 60-days after the expiration of the warranty or within one year of purchasing the vehicle, whichever comes first.

    Final Chance

    • Once a reasonable number of opportunities have been granted, a final notification must be made in writing before the lemon law may be enacted. This letter must state the nature of the issue with the vehicle, explain that several attempts have already been made to repair the vehicle and it must include a request for a refund or replacement. Once the dealer receives this notice, he has 30 days to complete repairs on the vehicle.

    Exceptions

    • The lemon law does not apply if the issue does not substantially impair the use or value of the vehicle. In addition, if the owner has made any unauthorized modifications or has abused or neglected the vehicle, then the lemon laws will provide no protection.
