Auto Insurance Rights in Arkansas
- In nearly every state, auto insurance is required for drivers with vehicles. These states require that drivers carry liability insurance, which provides financial coverage for themselves and others in the event of an accident. However, the right to choose other types of auto insurance is an important right in many states, including the state of Arkansas. This is one of a few coverage rights for Arkansas drivers.
- While drivers in Arkansas are required to carry liability insurance for their vehicles, comprehensive and collision insurance isn't required. Still, when purchasing liability insurance, you have the right to purchase higher coverage amounts --- minimums as of 2010 are $25,000 per person, $50,000 per accident and $25,000 for property damage --- and to purchase either uninsured or underinsured motorist coverage. Also, according to the Arkansas Insurance Department, Arkansas drivers over the age of 55 who have completed an Office of Driver Services course are eligible for the college graduate and defensive driver discount.
- As stated by Auto Insurance Tips, "Auto insurance companies can use personal credit history to assess risk and determine rates." However, it's illegal for insurance companies to deny an individual auto insurance simply based on his credit report. A letter must come from the insurer stating clearly that other factors are used to determine coverage eligibility and price.
- As a tort state --- a state that makes injuries to a person or property compensable by law --- Arkansas requires that the driver who is at fault pay for the victim's medical expenses and repairs for damages to the victim's cars. The victim can also file a lawsuit to claim other compensation such as lost wages due to injury or disability, and pain and suffering. This requires that a driver have a significant amount of liability insurance. Consequently, drivers in Arkansas have the right and should carry higher amounts of insurance coverage.
