How to Get Copies of a Mortgage Deed Promissory Note

    • 1). Contact your lender. Your lender and settlement agent must have provided you with a copy of your mortgage when you signed your settlement papers at closing, according to the federal Real Estate Settlement and Procedures Act and the federal Truth in Lending Act.

    • 2). Contact your settlement attorney or agent. This is the place where you conducted your loan closing. You signed your mortgage or promissory note at the settlement or title agent's office who notarizes your documents and records them on your lender's behalf. The Real Estate Settlement Procedures Act requires that all settlement agents retain records for at least five years. Your settlement agent may charge you to provide you with a copy of your forms, but you can request a copy from your agent.

    • 3). Visit your local circuit court, county recorder's office or clerk of land records. Each county or city will have a land records division where land records are public information.

    • 4). Ask your local circuit court for a copy of your promissory note, mortgage note or deed of trust.
