Procedural Dismissal

  • Sometimes when you file a bankruptcy case it may be dismissed rather than discharged. Dismissal means that your case is effectively over, and the court has not granted you any relief from your creditors. Many dismissals are procedural in nature, and easily correctable. For example, if you forget to include all the necessary forms in your bankruptcy petition, or if you do not pay the required fees in time, the court will automatically dismiss your petition. In these types of procedural dismissals, you can usually file bankruptcy again immediately upon satisfaction of your delinquency, such as paying the required fees or providing the necessary forms.
