What Is an Inchoate Crime?
- Criminal attempt to commit an offense mainly revolves around the failure to complete the crime. The attempt with specific intent is a crime and an example of an inchoate offense.
- Conspiring with another to commit a crime is an example of an inchoate crime. The central element of a conspiracy is the agreement. Proof of an agreement is often not necessary, just the existence of the agreement is enough.
- When a person builds a mechanism such as a meth lab, then acquires the chemicals substances used to make the meth, they have committed an inchoate offense. As with other inchoate offenses, it is the intent to commit the crime that matters, not the completion of the crime.
