How to File Legal Separation in the Military

    • 1). Go to your local county courthouse in the area where you reside. Each state has different residency requirements, and you must have lived there for a certain period of time before filing for legal separation. The clerks at the courthouse can tell you if you qualify and give you the necessary petition forms to fill out.

    • 2). Fill out the petition forms. Include all of the personal information asked for in the forms, and take a total inventory of your wealth and possessions. Your petition must include how the wealth will be divided, parental and visitation rights, alimony and any other issues that you and your spouse will need to settle if you follow through and get a full divorce.

    • 3). File the legal separation petition with the court and pay all necessary filing fees. A copy of the petition will be served on your spouse by a court representative. Once that has happened, you both need to sign the official version of the papers and return them to the court to make the legal separation official.
